GTC Internet Shop
Section 1: Scope of Application
The following general terms and conditions apply to all the contracts between 7burg UG (limited liability), Hansastr. 9A, 06118 Halle (Saale) and consumers and/or entrepreneurs, in their applicable version at the time of the order.
According to Section 13 of the German Civil Code (BGB), a consumer is any natural person who enters into a legal transaction for a purpose that is outside his trade, business or profession. According to Section 14 of the German Civil Code (BGB), an entrepreneur means a natural or legal person or a partnership with legal personality who or which, when entering into a legal transaction, acts in exercise of his or its trade, business or profession.
Section 2: Contract Conclusion
The purchase agreements concerning the products offered in the Internet shop are concluded with 7burg UG (limited liability). The agreement texts are available exclusively in German. We retain the title to the delivered goods until the full payment of the purchase price.
Until the contract is concluded, you may correct your data by selecting the “Back” function in your web browser and changing your details there.
The products shown in the Internet shop do not represent legally binding offers. A legally binding offer is made by sending the order. After submitting the order, you will receive an automatic confirmation e-mail about your order. This does not constitute an acceptance of the offer. The acceptance takes place after the verification via the confirmation e-mail for the allocation of the ordered goods for shipping.
Section 3: Technical Information
You can correct your details in the final order summary, before the contract is concluded. If you select the “Back” function in your web browser, you must refresh the browser. The goods are still in the shopping cart. You can then restart the input process and enter your details there again.
You can also save the contract text as a web page on your PC or on a connected storage medium via your web browser by selecting “Save As”, or you can print it out via your web browser by using the “Print” function, provided that you have connected a suitable device.
We do not save the contract text. Only delivery notes and invoices are created and stored via our checkout system. These are available on request.
For the conclusion of contracts in our Internet shop, no codes of conduct apply besides the statutory provisions.
Section 4: Vouchers
Discounts cannot be combined with vouchers. Only one voucher can be used per order. Vouchers cannot be exchanged for cash.
Section 5: Consumer Rights
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
To exercise the right of withdrawal, you must inform us 7burg UG (haftungsbeschränkt), Hansastr. 9A, 06118 Halle (Saale), email@example.com, Tel.: 0345 682 065 11 Fax: 0345 682 065 12 of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest

without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired
You will have to bear the direct cost of returning the goods
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods
Section 6: Return Costs
If you exercise your right to cancel, you will have to bear the regular return costs.
Section 7: Payment Terms
The payment of goods is made exclusively on the basis of advance payment. The payment can be made via PayPal, PayPal Plus, PayPal Purchase on Account, bank transfer or cash on collection. The bank details will be communicated to you with the order confirmation.
All prices listed in the online shops include 19% VAT. The indicated prices include all the price components, with the exception of the shipping costs, provided these are listed separately. These are listed separately in the product description.
The final shipping costs for your order will be communicated to you during the ordering process. For deliveries abroad, the customs duties and taxes are borne by the purchaser.
Offsetting is only possible for claims that have been legally established or are undisputed by 7burg UG (limited liability).
Section 8: Delivery
Goods are shipped exclusively against payment in advance. The ordered goods will be delivered in Germany within five working days from the working day following the day of issuance of the payment order. If the last day of the delivery period falls on a Sunday, a national public holiday recognized at the place of delivery or on a Saturday, such a day will be replaced by the following working day.
Section 9: Shipping Costs
The sale and shipping takes place from our company headquarters. The shipping costs are borne by the purchaser.
We usually ship with Deutsche Post and DHL. The shipping costs are included in the respective product description.
Section 10: Liability for Defects
The liability for defects in the purchased goods is governed by the statutory provisions. Claims for damages by the purchaser due to obvious material defects of the delivered goods are excluded if such defects are not notified to us within a period of two weeks after the delivery of the goods.
Our liability for damages, for whatever legal reason (especially in case of delays, defects or other breaches of duty), is limited to contractually typical and foreseeable damages. The above limitations of liability shall not apply to our liability for damages resulting from injury to life, limb or health caused by a negligent breach of duty by 7burg UG (limited liability) or a willful or negligent breach of duty by a legal representative or vicarious agent of 7burg UG (limited liability). Furthermore, they shall not apply to other damages caused by a grossly negligent breach of duty by 7burg UG (limited liability) or a willful or grossly negligent breach of duty by a legal representative or vicarious agent of 7burg UG (limited liability).
In the context of a warranty for quality and/or durability, the provisions of the warranty agreement apply differently. The provisions under the German Product Liability Act shall remain unaffected.
Section 11: Applicable Law
All contracts concluded with us are subject to the laws of the Federal Republic of Germany.
Section 12: Place of Jurisdiction
For all the disputes arising out of or in connection with contracts concluded with us, the place of jurisdiction is Halle (Saale).
Section 13: Alternative Dispute Resolution
With the Law on Alternative Dispute Resolution in Consumer Affairs (German Consumer Dispute Settlement Act - VSBG), the legislator has adopted Directive 2013/11/EU of the European Parliament and of the Council of 21.03.2013.
We do not participate in the settlement of disputes under the VSBG. A duty of participation under the VSBG does not exist for us.
